When those with a direct interest in an estate are chosen as fiduciaries, the outcome for both the beneficiaries and the person honouring the appointment is often less than satisfactory. The undertaking as a personal representative can be even more difficult due to the complex, time-consuming and stressful nature of the executor role. The high standards and expectations of an estate's beneficiaries often come as an unwelcome surprise, which can lead to unpleasant family conflict, costly mistakes, and potential litigation.
An agent to the named executor is an advisor who the named representative can retain to carry out duties on their behalf.
This may be desirable where the named executor still wishes to be the ultimate trustee of the estate and continue to have the overriding authority to administer an estate; but:
